Argentina’s Data Protection Act No. 25,326 establishes the obligation to register data protection controllers and their databases with the National Data Protection Authority (NDPA). Until now, it was not possible to register a foreign controller before the NDPA. However, the Agency of Access to Public Information (AAPI) published yesterday a new form, putting and end to this problem.
The new form regarding personal data controllers in Argentina
The AAPI included a new online form in order for foreign data controllers to comply with the Data Protection Act. The form requires to declare information on the person authorised to proceed with the registration, information on the controller and documentation regarding the representation.
In this way, both national and foreign Personal Data Controllers in Argentina will now be able to register before the AAPI, in order to comply with the law. Additionally, argentinian citizens will be able to exercise their rights of access, rectification or deletion of their personal data.
