Trademark registration process in Argentina

1. Filing the application

   First, trademark registration application in Argentina is filed with the National Institute of Industrial Property (INPI).
   

2. Formalities examination

   Once the INPI receives the application, it confirms whether all formalities are fulfilled and if there is any missing requirement, it grants a period of thirty (30) days to amend the request.
   

3. Publication

   Once the trademark passes the formalities examination, INPI publishes it in the trademarks bulletin for one (1) day.

4. Opposition period

   After the publication, a 30 (thirty) days period begins to run for third parties to file oppositions to the trademark application.
   
   In case third parties don’t file oppositions to the application, the process continues at step 5. Otherwise, if third parties filed oppositions to the application, the process stops until the parties solve it.

5. Substantive examination

   Once the opposition period expires, and in case third parties do not file oppositions or the applicant removes them, INPI carries out a substantive examination regarding the registrability of the trademark. INPI in this step can make administrative observations and grants the applicant a period to answer them. Please, note that the applicant must answer them with the sponsorship of a lawyer or an industrial property agent.
   

6. Final decision

   If the Trademarks Office considers that the trademark is distinctive, it won’t create confusion with previous registered trademarks and meets all requirements of the law, it grants the registration.

7. Issue of title

   After registration, INPI grants the Trademark title and the protection lasts for 10 (ten) years from the registration date. The trademark can be renewed for periods of 10 (ten) years indefinitely.
